1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and Sovereign Intelligence Systems, LLC, doing business as Articlefoundry ("we," "our," or "us"), governing your access to and use of the Articlefoundry platform and services available at articlefoundry.com (the "Service").

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

You must be at least 18 years old and have the legal capacity to enter into contracts to use this Service. By using the Service, you represent and warrant that you meet these requirements.

2. Description of Service

Articlefoundry is an AI-powered content generation platform that creates SEO-optimized articles with real sources and citations. The Service includes:

AI-generated article ideas based on your selected niches and preferences
Full-length article generation with research, citations, and source references
AI-generated images customized to your brand preferences
Article review and approval workflow
Direct publishing integration with WordPress and Ghost platforms
Download and export options for generated content

The Service utilizes artificial intelligence technologies, including but not limited to large language models and image generation models, to create content. While we strive for accuracy and quality, AI-generated content may contain errors, inaccuracies, or require human review.

3. Account Registration

To use the Service, you must create an account. When registering, you agree to:

Provide accurate, current, and complete information
Maintain and promptly update your account information
Maintain the security of your account credentials
Accept responsibility for all activities that occur under your account
Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that contain false or misleading information, or that violate these Terms.

4. Free Trial

We offer a free trial that allows new users to generate one (1) article without payment. The free trial is subject to the following conditions:

Limited to one free article per person, household, or device
We use browser fingerprinting technology to enforce this limit and prevent abuse
Attempting to circumvent the free trial limit through multiple accounts, devices, or other means is a violation of these Terms
Free trial articles may not be published directly through our WordPress/Ghost integration; publishing requires a paid subscription

We reserve the right to modify or discontinue the free trial at any time without notice.

5. Subscriptions and Billing

5.1 Subscription Plans

Access to the full Service requires a paid subscription. We offer several subscription tiers with different monthly article limits. Current pricing and plan details are available on our website and may be updated from time to time.

5.2 Billing

Subscriptions are billed in advance on a monthly basis. By subscribing, you authorize us to charge your payment method on file for the applicable subscription fees. Payment processing is handled by Stripe, and you agree to Stripe's terms of service.

5.3 Article Limits and Usage

Each subscription plan includes a specified number of articles per billing cycle. Unused articles do not roll over to subsequent billing periods. Article usage is counted upon successful completion of article generation. If generation fails due to a technical error on our end, the article will not count against your limit.

5.4 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings or by contacting support.

5.5 Refunds

Due to the nature of AI-generated content, we generally do not offer refunds for subscription fees. However, we may consider refund requests on a case-by-case basis for:

Service outages or technical failures that prevented you from using the Service
Billing errors or duplicate charges
Requests made within 48 hours of initial subscription if no articles have been generated

To request a refund, contact support@articlefoundry.com with your account details and reason for the request.

5.6 Price Changes

We reserve the right to modify subscription prices. Any price changes will be communicated to existing subscribers at least 30 days before taking effect. Continued use of the Service after a price change constitutes acceptance of the new pricing.

6. Content Ownership and License

6.1 Your Content

You retain ownership of any content you provide to the Service, including your preferences, topic selections, and any materials you upload.

6.2 Generated Content

Subject to your compliance with these Terms and payment of applicable fees, we grant you a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, and distribute the articles and images generated for your account through the Service. This license is perpetual and survives termination of your account.

Free Trial Content: Content generated during your free trial is granted the same license as paid content. However, direct publishing through WordPress/Ghost integrations requires a paid subscription.

You are solely responsible for:

Reviewing generated content before publication
Verifying the accuracy of facts, statistics, and citations
Ensuring content complies with applicable laws and regulations
Any consequences arising from your use or publication of generated content

6.3 Our Intellectual Property

The Service, including its design, features, functionality, underlying technology, and all related intellectual property, remains the exclusive property of Sovereign Intelligence Systems, LLC. These Terms do not grant you any rights to our trademarks, logos, or brand elements.

6.4 Feedback License

If you provide us with feedback, suggestions, ideas, or recommendations regarding the Service ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free, fully sublicensable license to use, reproduce, modify, adapt, publish, distribute, and display such Feedback for any purpose without compensation or attribution to you. You waive any "moral rights" in such Feedback. This license survives termination of these Terms.

7. Acceptable Use

You agree not to use the Service to:

Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
Create content that infringes on intellectual property rights of others
Produce spam, misleading content, or content designed to manipulate search rankings through deceptive practices
Generate content that promotes violence, discrimination, or hatred
Create content that impersonates real individuals without their consent
Circumvent free trial limitations or engage in fraudulent activity
Resell, redistribute, or sublicense the Service without authorization
Attempt to reverse engineer, decompile, or extract the underlying AI models or systems
Overload, disable, or impair the Service or interfere with other users' access
Violate any applicable laws or regulations

We reserve the right to suspend or terminate accounts that violate these acceptable use provisions, without refund.

8. Copyright and DMCA Policy

We respect the intellectual property rights of others. If you believe that content generated through our Service or available on our platform infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (DMCA) to our designated agent:

We will respond to valid DMCA notices by removing or disabling access to the allegedly infringing material and, in appropriate circumstances, terminating repeat infringers.

9. Third-Party Integrations

The Service integrates with third-party platforms including WordPress and Ghost for content publishing. When you connect these integrations:

You are responsible for maintaining valid credentials and permissions
You must have authorization to publish content to the connected sites
We are not responsible for issues arising from your third-party platform configurations
Third-party platforms are subject to their own terms of service

10. Disclaimers

10.1 Service Provided "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

10.2 AI-Generated Content

We do not warrant that:

Generated content will be accurate, complete, or error-free
Sources and citations will be valid or current
Content will be suitable for your specific purposes
Content will achieve any particular search ranking or traffic results
Generated images will be free from artifacts or imperfections

IMPORTANT AI DISCLAIMER: AI-generated content may contain factual errors, fabricated citations, hallucinated sources, or inaccurate information. Citations and source references included in generated articles are created by AI systems and may not correspond to real publications, may contain incorrect URLs, or may misattribute information. You are solely responsible for verifying all facts, citations, and sources before publishing any generated content. We strongly recommend human review and fact-checking of all AI-generated material.

You acknowledge that AI technology has inherent limitations and that human review of generated content is required before publication.

10.3 Service Availability

We do not guarantee uninterrupted access to the Service. The Service may be subject to limitations, delays, and other problems inherent in the use of the internet and electronic communications. We are not responsible for delays, delivery failures, or other damages resulting from such problems.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SOVEREIGN INTELLIGENCE SYSTEMS, LLC (D/B/A ARTICLEFOUNDRY), ITS MEMBERS, MANAGERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

Loss of profits, revenue, or business opportunities
Loss of data or content
Reputational damage
Damages arising from reliance on generated content
Any other intangible losses

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Sovereign Intelligence Systems, LLC (d/b/a Articlefoundry) and its members, managers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

Your use of the Service
Your violation of these Terms
Your publication or distribution of generated content
Your violation of any rights of a third party
Any content you submit to the Service

13. Termination

You may terminate your account at any time by canceling your subscription and contacting us to request account deletion. We may suspend or terminate your account at any time, with or without cause, with or without notice, including for:

Violation of these Terms
Fraudulent or illegal activity
Non-payment of subscription fees
Extended periods of inactivity (12 months or more without login)
At our sole discretion for any reason

Upon termination, your right to use the Service ceases immediately. We may delete your account data in accordance with our Privacy Policy. The license granted to you for generated content survives termination.

14. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of New Hampshire, United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the Consumer Arbitration Rules of the American Arbitration Association ("AAA"). Arbitration shall be conducted in New Hampshire or, at your election, by telephone or video conference. The arbitrator's decision shall be final and binding.

Arbitration Costs: If your claim is for $10,000 or less, we will pay all arbitration fees. For claims over $10,000, arbitration fees will be allocated as determined by the AAA Consumer Arbitration Rules.

Small Claims Exception: Notwithstanding the above, either party may bring an individual action in small claims court if the claim qualifies for small claims court jurisdiction in your state of residence or New Hampshire.

Class Action Waiver: You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against Sovereign Intelligence Systems, LLC (d/b/a Articlefoundry). You may only bring claims against Sovereign Intelligence Systems, LLC in your individual capacity.

Time Limitation: Any claim or cause of action arising from or relating to these Terms or the Service must be filed within one (1) year after such claim or cause of action arose, or it shall be forever barred.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. For significant changes, we may also notify you via email.

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and cancel your subscription.

16. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sovereign Intelligence Systems, LLC (d/b/a Articlefoundry) regarding the Service.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of war or terrorism, labor disputes, government actions, internet or telecommunications failures, or AI service provider outages.
Notice: We may provide notices to you by email to the address associated with your account, by posting on the Service, or by other reasonable means. You are responsible for keeping your email address current. Notices sent by email are deemed received when sent. Notices posted on the Service are deemed received upon posting. You may provide notice to us at support@articlefoundry.com.
Electronic Communications: By using the Service, you consent to receiving electronic communications from us, including emails and notices posted on the Service. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
Export Compliance: You may not use or access the Service from any country or territory subject to U.S. economic sanctions or if you are on any U.S. government prohibited party list. You represent that you are not located in, under the control of, or a national or resident of any such country or on any such list.
Beta Features: From time to time, we may offer beta or experimental features. Such features are provided "as is" without warranties of any kind. We may discontinue beta features at any time without notice or liability.
Headings: Section headings are for convenience only and shall not affect the interpretation of these Terms.
No Agency: Nothing in these Terms shall be construed as creating a joint venture, partnership, employment, or agency relationship between you and Sovereign Intelligence Systems, LLC. You have no authority to bind Sovereign Intelligence Systems, LLC in any respect.
No Third-Party Beneficiaries: These Terms are for the sole benefit of you and Sovereign Intelligence Systems, LLC. Nothing in these Terms shall confer any rights or remedies upon any person or entity other than you and Sovereign Intelligence Systems, LLC.
Survival: The following sections shall survive any termination of these Terms: Content Ownership and License (Section 6), Disclaimers (Section 10), Limitation of Liability (Section 11), Indemnification (Section 12), Governing Law and Disputes (Section 14), and this General Provisions section.
